Overview

The H-2A program serves as a bridge for agricultural employers in the U.S., allowing them to hire nonimmigrant foreign workers for temporary or seasonal agricultural tasks when domestic workers are scarce.

For the U.S. Citizenship and Immigration Services (USCIS) to approve such a request, the agricultural employer needs to confirm with the Department:

  • A scarcity of able, willing, and qualified U.S. workers.
  • The employment of foreign individuals will not negatively impact the conditions and wages of U.S. workers in similar roles.

Employers also commit to proactive recruitment efforts, involving newspaper and radio advertising in probable labor supply regions. These efforts should be on par or exceed those of other non-H-2A agricultural employers for similar roles.

The U.S. Department of Labor (DOL) oversees the recruitment process for H-2A positions. They can:
  • Refer potential candidates via the state employment service agency.
  • Receive and acknowledge independent recruitment by employers.
  • Directly engage in the recruitment post-certification.

H-2A visas are typically valid for a year but can be extended annually, with a three-year cap.
